Germany’s Cannabis Law 2026: What’s Allowed and What’s Not?

Cannabis in Germany in 2026: Your Straightforward Guide to the CanG
Welcome to 2026. Germany’s Cannabis Act, known as the CanG, has now been in force for a little over two years. The initial excitement and confusion have settled, leaving a much clearer picture. But what does that mean for you, whether you live here or are just visiting? The rules are very German: specific, with strict limits, and not always self-explanatory. Here’s your straightforward, honest guide to cannabis in Germany, so you know exactly where you stand.
The CanG: A Quick Look Back at Partial Legalisation
The Cannabis Act came into force on 1 April 2024, ending decades of prohibition. Possession of small amounts and private cultivation were decriminalised for adults. The law is based on a two-pillar model. Pillar 1, implemented in 2024, focuses on non-commercial cultivation at home and through cultivation associations, also known as Cannabis Social Clubs. Pillar 2 provides for commercial pilot projects in selected regions, monitored by researchers. In 2026, the reality is that this second pillar is still a work in progress. The focus remains firmly on Pillar 1: private access to cannabis.
Possession and Consumption: The Golden Rules
This is where you need to pay close attention, because the rules are precise. If you’re 18 or over, you can legally possess cannabis. However, you must always carry ID to prove your age.
The permitted amounts are:
- In public: up to 25 grams of dried cannabis.
- At home: up to 50 grams of dried cannabis.
Carrying more than 25 grams in public is illegal. There’s a fine line between an administrative offence, similar to a parking violation, and a criminal offence, so stick to the limit.
The rules on consumption are even more important. You can’t smoke just anywhere. Consumption is prohibited:
- Within 100 metres, measured in a straight line, of schools, nurseries, playgrounds and public sports facilities.
- In pedestrian zones between 7 am and 8 pm.
- In the immediate presence of anyone under 18.
- Inside Cannabis Social Clubs and within sight of their premises.
The basic rule: be discreet, keep your distance from children and teenagers, and use common sense. Smoking on a walk through the park is often fine, but not right beside a playground.
Home Growing: Put Your Green Fingers to Work
If you live in Germany, you can legally grow your own cannabis. This is one of the key freedoms introduced by the new law. Here, too, the rules are clearly defined:
- Three flowering female plants are permitted per adult in the household.
- The plants and harvested cannabis must be securely protected against access by children and other people. A lockable cupboard or a separate room is required.
- Home-grown cannabis is for personal consumption only. You cannot sell it or give it to anyone else.
Buying seeds from EU countries for private cultivation is legal. This has allowed many people to start growing at home without relying on the black market.
Cannabis Social Clubs: Where Do They Stand in 2026?
Since 1 July 2024, cultivation associations, better known as Cannabis Social Clubs, have been allowed to operate. Two years on, many clubs have been established and are supplying their members. However, the model is tightly regulated and, unfortunately, offers no access for tourists.
To join a club, you must:
- Be at least 18 years old.
- Have had your residence or usual place of residence in Germany for at least six months.
- Hold access rights to only one club at a time.
These clubs are not coffeeshops or lounges. They are associations that grow cannabis on behalf of their members and distribute it at cost. Consumption inside the club is strictly prohibited. Distribution is limited to a maximum of 25 grams per day and 50 grams per month. Young adults aged 18 to 21 face even stricter rules: a maximum of 30 grams per month, with cannabis subject to a THC content limit.
A quick note: Because German cultivation associations operate on a non-commercial, residents-only model, tourists cannot join them. Zazapass lists smoking lounges and 420 events in Germany and does not sell club memberships. Germany’s system is a closed loop for local residents.
Cannabis and Driving: Better Safe Than Sorry
Driving under the influence of cannabis was widely debated after 2024. A clear threshold has since replaced the old zero-tolerance policy. The new limit is 3.5 nanograms of THC per millilitre of blood serum. Experts consider this comparable to a blood alcohol concentration of 0.02%.
If you’re caught above this limit, you face substantial fines, typically starting at €500, penalty points on Germany’s national driving register in Flensburg, and a driving ban. Much tougher penalties apply if you cause an accident or show signs of impairment. The simplest and safest rule is this: if you’ve consumed cannabis, leave the car parked. It’s better to wait an extra day before getting behind the wheel again.
Medical Cannabis: A Separate Route
Medical care operates entirely separately from recreational use. Medical cannabis has been available on prescription since 2017 and, since 1 April 2024, has been governed by the Medical Cannabis Act (MedCanG). It is no longer covered by Germany’s Narcotics Act, which has made it easier for doctors to prescribe.
If you are a patient, only your treating doctor decides whether a prescription is possible. The medical route is not an alternative for recreational use. Services such as zazaxpress.com offer medical treatment via telemedicine. A prescription is not guaranteed and is only issued once all criteria are met. With a valid prescription, ZazaXpress offers express pickup or delivery* in Hamburg, Bremen, Berlin, Cologne, Osnabrück, Dortmund, Augsburg and Leipzig; Munich, Stuttgart and Düsseldorf are coming soon. Medical patients can use the code ZAZA to save 50% on the platform fee.
*Important: A prescription is not guaranteed. It can only be issued after medical treatment and once all criteria are met. Whether that is the case is decided solely by the treating doctor. Fast pickup or delivery is only possible with a valid prescription.

FAQ: Frequently Asked Questions About the CanG in 2026
Can I legally buy cannabis in Germany as a tourist?
No. That’s the short, honest answer. There are no legal coffeeshops or dispensaries where tourists can buy cannabis. Cannabis Social Clubs are exclusively for people who live in Germany. Anyone offering you cannabis on the street is acting illegally. The quality is questionable, and buying it is a criminal offence. For patients, medical treatment can be a route, although a prescription is not guaranteed.
What happens if I’m caught with more than 25 grams?
Penalties for exceeding the permitted amounts depend on how much you have. Possessing up to 30 grams in public, rather than the permitted 25, or up to 60 grams at home, rather than 50, is treated as an administrative offence. This can result in a fine. Anything above those amounts is treated as a criminal offence and can have serious legal consequences, including criminal fines or even imprisonment.
Can I buy cannabis seeds or cuttings?
Yes, under certain conditions. Buying cannabis seeds from other EU member states for private home growing is legal. Many people order them online. Cuttings, or clones, may legally be supplied only by cultivation associations to their members for growing at home. The limit is five cuttings per month.
What does the future hold? Are coffeeshops coming?
That’s the big question surrounding Pillar 2 of the law. This pillar provides for regional pilot projects with licensed specialist shops allowed to sell cannabis commercially. As of 2026, these projects are still in the planning stages. Red tape and political debate have slowed progress. There is no firm timetable for when these shops might open or in which cities. For now, a nationwide network of Dutch-style coffeeshops remains a distant prospect.
Germany has taken a distinctive approach with the CanG. For residents, much has changed for the better, even if the rules are complicated. As a visitor, however, you should be aware that Germany is not a cannabis tourism destination in the same way as Spain or the US. Respect the law, be careful and enjoy your time here.
*Applies only with a valid prescription. A prescription is not guaranteed: it can only be issued after medical treatment and once all criteria are met. Availability, delivery times and pickup depend on location and pharmacy.
